Two fifth-graders face trial in alleged Washington murder plot

SEATTLE (Reuters) - Two Washington state fifth-grade boys, accused in a foiled plot to rape and kill a girl and kill or harm six other classmates, will stand trial as juveniles, a prosecutor said on Friday.

Stevens County Prosecutor Tim Rasmussen said the boys, 11 and 10, pleaded not guilty during an arraignment on Friday over the alleged murder-rape plot that also targeted other children in Colville, Washington, about 215 miles east of Seattle.

One of the boys wanted the girl dead because "she's rude and always made fun of me and my friends," according to court documents.

"There are very few prosecutions of a crime of this magnitude with boys of this age," Rasmussen told Reuters.

Stevens County Superior Court Judge Allen Nielson determined during the hearing that the boys had the capacity to understand right and wrong, Rasmussen said.

Under Washington state law, children ages 8 to 12 are presumed not to have the mental capacity to form an intention to commit a crime. Juvenile court is typically reserved for defendants between ages 12 and 18.

The 10-year-old suspect was charged with conspiracy to commit first-degree murder, juvenile firearm possession and witness tampering, Rasmussen said.

The younger boy had taken a gun that originally belonged to his grandfather from his older brother's room, according to a declaration of probable cause.

The 11-year-old was charged with conspiracy to commit first-degree murder, possession of a dangerous weapon, a knife, at school and tampering with a witness, Rasmussen said.

The boys planned to lure the girl away from school in Colville, a town of 4,600 people in eastern Washington, according to court documents.

A teacher found a list of six more targeted classmates, prosecutors said.

The fifth-graders had boarded a school bus on February 7 with a knife, a semi-automatic pistol and ammunition in a backpack on their way to Fort Colville Elementary School, prosecutors said.

A fourth-grader on the bus saw the knife and reported it to a teacher's aide, prosecutors said. One of the suspects later said he would kill the student who told school officials about the weapons, they said.

If convicted of all charges, the boys could each be sentenced to 103 to 127 weeks unless a judge finds "manifest injustice" and orders a longer sentence, Rasmussen said.

The boys have been expelled from the school district indefinitely. A status hearing is set for April 8.

Who'd have thought we'd be happy to see an unassuming black box? Pope extends hand of friendship to "Muslim brothers and sisters" during Good Friday rite

ROME - Pope Francis reached out in friendship to "so many Muslim brothers and sisters" during a Good Friday procession dedicated to the suffering of Christians from terrorism, war and religious fanaticism in the Middle East.

The new pontiff, who has rankled traditionalists by rejecting many trappings of his office, mostly stuck to the traditional script during the nighttime Way of the Cross procession at Rome's Colosseum, one of the most dramatic rituals of Holy Week.

With torches lighting the way, the faithful carried a cross to different stations, where meditations and prayers were read out recalling the final hours of Jesus' life and his crucifixion.

This year, the prayers were composed by young Lebanese, and many recalled the plight of minority Christians in the region, where wars have forced thousands to flee their homelands. The meditations called for an end to "violent fundamentalism," terrorism and the "wars and violence which in our days devastate various countries in the Middle East."

Francis, who became pope just over two weeks ago, chose, however, to stress Christians' positive relations with Muslims in the region in his brief comments at the end of the ceremony.

Standing on a platform overlooking the procession route, Francis recalled Benedict XVI's 2012 visit to Lebanon when "we saw the beauty and the strong bond of communion joining Christians together in that land and the friendship of our Muslim brothers and sisters and so many others."

"That occasion was a sign to the Middle East and to the whole world, a sign of hope," he said.

Friday's outreach followed Francis' eyebrow-raising gesture a day earlier, when he washed and kissed the feet of two women, one a Muslim, in the Holy Thursday ritual that commemorates Jesus' washing of his apostles' feet during the Last Supper before his crucifixion.

Breaking with tradition, Francis performed the ritual on 12 inmates at a juvenile detention centre, rather than in Rome's grand St. John Lateran basilica, where in the past, 12 priests have been chosen to represent Jesus' disciples.

Before he became pope, the former Cardinal Jorge Mario Bergoglio long cultivated warm relations with Muslim leaders in his native Argentina. In one of his first speeches as pope, he called for the church and the West in general to "intensify" relations with the Muslim world.

The Vatican's relations with Islam hit several bumps during Benedict XVI's papacy, when he outraged Muslims with a 2006 speech quoting a Byzantine emperor as saying some of Prophet Muhammad's teachings were "evil and inhuman." And in 2011, the pre-eminent institute of Islamic learning in the Sunni Muslim world, Cairo's Al-Azhar institute, froze dialogue with the Vatican to protest Benedict's call for greater protection of Christians in Egypt.

However, Francis' past outreach to the Muslim community in Argentina seems to have changed that. Al-Azhar's chief imam, Sheik Ahmed el-Tayyib, sent a message of congratulations to Francis on his election and said he hoped for co-operation.

The Vatican's efforts to reconcile with the Islamic world have not been welcomed by all. Italy's most famous Muslim convert to Catholicism, Magdi Allam, announced last week he was leaving the church because of its "soft" stance on Islam. Allam was baptized by Benedict XVI in 2008 during the high-profile Easter Vigil service when the pope traditionally baptizes a handful of adults. There has been no Vatican comment on his about-face.

Thousands of people packed the Colosseum and surrounding areas for the nighttime procession, holding candles wrapped in paper globes as Francis sat in silent prayer as a giant torch-lit crucifix twinkled nearby. Some in the crowd had Lebanese flags around their shoulders in an indication of the special role Lebanese faithful played in this year's procession.

Lebanon has the largest percentage of Christians in the Middle East ? nearly 40 per cent of the country's 4 million people, with Maronite Catholics the largest sect. As civil war has raged in neighbouring Syria, Lebanon's Christian community has been divided between supporters and opponents of Syrian President Bashar Assad.

Overall, Christians in the Middle East have been uneasy as the Arab Spring has led to the strengthening of Islamist groups in most countries that have experienced uprisings. Thousands of Christians have fled the region ? a phenomenon that the Vatican has lamented, given Christianity's roots in the Holy Land.

"How sad it is to see this blessed land suffer in its children, who relentlessly tear one another to pieces and die!" said one of the Good Friday meditations. "It seems that nothing can overcome evil, terrorism, murder and hatred."

Francis picked up on that message, saying Christ's death on the cross is "the answer which Christians offer in the face of evil, the evil that continues to work in us and around us."

"Christians must respond to evil with good, taking the cross upon themselves as Jesus did," he said.

At the end of the ceremony, a male choir sang a haunting Arabic hymn, a reflection of the Eastern rite influence that infused the ceremony.

On Saturday, Francis presides over the solemn Easter Vigil ceremony in St. Peter's Basilica and on Sunday, he celebrates Easter Mass and delivers an important speech. Usually the pope also issues Easter greetings in dozens of languages.

In his two weeks as pope, Francis' discomfort with speaking in any language other than Italian has become apparent. The Vatican spokesman, the Rev. Federico Lombardi, said Friday "we'll have to see" what Francis does with the multilingual greetings.

The Good Friday procession was conducted entirely in Italian, whereas in years past the core elements recounting what happens at each station would be recited in a variety of languages.

Throughout this ?conscious mind chatter,? try to discern the messages your subconscious is sending you. The subconscious is like a computer ? it can?t lie. It only repeats information it has been given.

If you truly and subconsciously believe something false regarding your weight, make a note of this and end your session. Write down each false belief as soon as you?re done, making any notes or observations you picked up along the way. Study these beliefs and determine ways to tackle them individually. False beliefs are often easily addressed through self-hypnotic suggestions and conscious affirmations. Write these down as well. Refer to the list in future sessions and keep your affirmations in a handy place where you will see it several times each day. Imagine that you falsely believe that you are ?doomed? to be overweight. Refute this false belief with an affirmation such as ?I am in complete control of my health, appearance and weight.?

Future Sessions and Affrimations

Repeat your affirmations as often as possible. Whenever possible, do this in front of a mirror with a genuine smile on your face and conviction in your voice. Over time, these very true and positive statements will sink into your subconscious mind as fact. Remember to always word affirmations positively (avoid using words like ?can?t,? ?won?t,? ?don?t,? ?not? or ?shouldn?t,?) and in the present tense (?I am healthy? instead of ?I will be healthy?).

In future self-hypnosis sessions, utilize a combination of visualization and commands to retrain your subconscious mind. You may find the ?floating bubble? visualization very helpful, in which you wade through water toward several floating bubbles which represent different goals. In teh case of wight loss, these goals may be a certain number on the scale, a particular size of jeans or a fitness goal such as distance on a treadmill. Whatever your goals are, make them crisp, vivid and realistic.

When using commands, stick with the rules regarding affirmations. Instruct your subconscious using positive statements and the present tense.

Remember that healthy weight loss doesn?t happen overnight. Instead of dangerous crash diets or pills, self-hypnosis provides a gentle, natural and, in the long run, much more effective option. When you change the way you think, your body has no choice but to follow!

Crisis hotlines turning to text to reach teens

NEW YORK (AP) ? They stream in a couple of dozen times a week, cries for help in bursts of text to DoSomething.org, a nonprofit more used to texting out details to teens on good causes and campaigns than receiving them from young people in crisis.

"I feel like committing suicide," one text read. "What's the suicide hotline number?" Another asked: "How do you tell a friend they need to go to rehab?"

DoSomething isn't a hotline, but its CEO, Nancy Lublin, decided to, well, do something. She's leading an effort to establish a 24/7 national text number across trigger issues for teens in the hope that it will become their 911, perhaps reaching those who wouldn't otherwise seek help using more established methods of telephone talking or computer-based chat.

"Most of the texts we get like this are about things like being bullied," Lublin said. "A lot of things are about relationships, so we'll get texts from kids about breakups, or 'I like a boy, what should I do?' But the worst one we ever got said, 'He won't stop raping me. It's my dad. He told me not to tell anyone. Are you there?'"

Lublin hopes the Crisis Text Line, due to launch in August, will serve as a New York-based umbrella, shuttling texts for help to partner organizations around the country, such as The Trevor Project for gay, lesbian, bisexual and questioning youth or other groups already providing hotlines on dating and sexual abuse to bullying, depression and eating disorders.

As more teens have gone mobile, using their phones as an extension of themselves, hotline providers have tried to keep up. Fewer seem to operate today than in decades past. A smattering reach out through mobile text, including Teen Line in Los Angeles, though that service and others offer limited schedules or are "siloed," as Lublin put it, specializing in narrow areas of concern when multiple problems might be driving a teen to the brink.

Some text providers operate in specific towns, counties or regions and-or rely on trained teen volunteers to handle the load across modes of communication. Several agreed that text enhances call-in and chat options for a generation of young people who prefer to communicate by typing on their phones, especially when they don't want parents, teachers, friends or boyfriends to listen in.

"We've had people who are walking and they just needed to get out of their house because they had an argument with their parent, so they're texting us as they're calming down," said Jennifer James, who supervises chat and text outreach for Common Ground, which also serves adults from its base in southeastern Michigan.

Katie Locke, 26, in Philadelphia was one of those teens in 2006, when she found herself in a suicidal panic after a fight with an old friend.

At 18, she said she grabbed her phone, left her college dorm room and headed out in the cold to sit on a bench to talk with a worker on a crisis phone line she knew from one of her favorite blogs. The number was the only one she had handy and it didn't offer text, which she would have preferred.

"People don't always have the (mobile phone) minutes or aren't in a position where they can speak aloud if they're in danger from somebody around them," Locke said. "I know for me there were other times when I probably should have called a crisis hotline and didn't because of the anxiety about calling. That was such an enormous barrier, to have to dial a phone number."

Brian Pinero, director of the National Dating Abuse Helpline run by a nonprofit called Love is Respect, knows that lesson well.

The organization launched phone and computer-based chat in 2007, and chat quickly grew to the more heavily used method of contact. The Austin, Texas-based group launched text in 2011 and it's now about 20 percent of the operation, Pinero said.

"Many times the phone is actually the most powerful computer in the home, but also for people who are of lower socio-economic status, they may not have the ability to engage in chat. Text messaging is something that is even offered on pay-as-you-go phones."

According to research from the Pew Internet & American Life Project, one in four teens is a "cell-mostly" Internet user. Texting among teens increased from about 50 texts a day in 2009 to about 60, with the number running into hundreds for some.

"Phone calls are not the way young people express themselves," said Danah Boyd, a senior researcher at Microsoft Research and an assistant professor of media, culture and communication at New York University.

"And one of the big problems that's emerged is hotlines are splintered across a ton of different phone numbers. Young people don't know them," said Boyd, who sits on the board of Crisis Text Line.

Comparisons of text hotline volume and efficiency are hard to come by. Researcher Deb Levine, executive director and founder of the nonprofit ISIS, for Internet Sexuality Information Services, said it's clear the number of hotlines of all kinds has declined significantly since a heyday in the Just Say No 1980s.

But chat and text help have been on the rise for more than two years, she said. Most are small-scale operations serving specific communities, said Levine, who lives in the San Francisco Bay area.

"Hotlines are always going to serve a purpose for some teens. Some of them are going to pick up the phone and call, some of them are going to text. I do believe that there's only so much you can do in 160 characters," she said. "There is a power to voice."

The Planned Parenthood Federation of America is in its second year of running one of the largest text and chat outreach operations for people ages 15 to 24, targeting African-American and Latino youth through promotional campaigns on MTV, websites and mobile providers, social media, wallet cards, video and Seventeen magazine.

Through February, nearly 185,000 conversations ? 22,447 via text ? were recorded, according to Planned Parenthood. About a third of conversations on health-related topics ? including birth control, abortion and pregnancy tests ? were with users both under 25 and African-American or Latino.

And nearly all chat and text users ages 15 to 24 agreed or strongly agreed that they were satisfied with their conversations, indicating significantly decreased levels of worry afterward.

"What we've seen from our online chat and text-messaging program is that they appreciate a real answer, in real time, from a real person," said Leslie Kantor, Planned Parenthood's vice president of education.

Evie Priestman, 14, an eighth-grader in Arlington, Va., has called hotlines as recently as a month ago, when she reached out for information on fending off suicidal thoughts, but she hasn't tried text.

"I think teens would definitely use a hotline if they could text to it. I know I would," she said. "Most teens keep their feelings to themselves."

Debbie Gant-Reed sees the need every day. She's the crisis lines coordinator at a 24-hour help line in Reno, Nev., called the Crisis Call Center. The center has been providing 24-hour text help for two and a half years, fielding about 500 text conversations a month.

"We're now taking texts from all over the country," she said. "You can chat all you want but you're going to get older people. Young people don't chat. They text."

Engineers at Oregon State University have developed a new interactive system to create networks of small wetlands in Midwest farmlands, which could help the region prevent massive spring floods and also retain water and mitigate droughts in a warming climate.

The planning tool, which is being developed and tested in a crop-dominated watershed near Indianapolis, is designed to identify the small areas best suited to wetland development, optimize their location and size, and restore a significant portion of the region's historic water storage ability by using only a small fraction of its land.

Using this approach, the researchers found they could capture the runoff from 29 percent of a watershed using only 1.5 percent of the entire area.

The findings were published in Ecological Engineering, a professional journal, and a website is now available at http://wrestore.iupui.edu/ that allows users to apply the principles to their own land.

The need for new approaches to assist farmers and agencies to work together and use science-based methods is becoming critical, experts say. Massive floods and summer droughts have become more common and intense in the Midwest because of climate change and decades of land management that drains water rapidly into rivers via tile drains.

"The lands of the Midwest, which is one of the great food producing areas of the world, now bear little resemblance to their historic form, which included millions of acres of small lakes and wetlands that have now been drained," said Meghna Babbar-Sebens, an assistant professor of civil and construction engineering at Oregon State. "Agriculture, deforestation, urbanization and residential development have all played a role.

"We have to find some way to retain and slowly release water, both to use it for crops and to prevent flooding," Babbar-Sebens said. "There's a place for dams and reservoirs but they won't solve everything. With increases in runoff, what was once thought to be a 100-year flood event is now happening more often.

"Historically, wetlands in Indiana and other Midwestern states were great at intercepting large runoff events and slowing down the flows," she said. "But Indiana has lost more than 85 percent of the wetlands it had prior to European settlement."

An equally critical problem is what appears to be increasing frequency of summer drought, she said, which may offer a solid motivation for the region's farmers to become involved. The problem is not just catastrophic downstream flooding in the spring, but also the loss of water and soil moisture in the summer that can be desperately needed in dry years.

The solution to both issues, scientists say, is to "re-naturalize" the hydrology of a large section of the United States. Working toward this goal was a research team from Oregon State University, Indiana University-Purdue University in Indianapolis, the Wetlands Institute in New Jersey, and the U.S. Environmental Protection Agency. They used engineering principles, historic analysis and computer simulations to optimize the effectiveness of any land use changes, so that minimal land use alteration would offer farmers and landowners a maximum of benefits.

In the Midwest, many farmers growing corn, soybeans and other crops have placed "tiles" under their fields to rapidly drain water into streams, which dries the soil and allows for earlier planting. Unfortunately, it also concentrates pollutants, increases flooding and leaves the land drier during the summer. Without adequate rain, complete crop losses can occur.

Experts have also identified alternate ways to help, including the use of winter cover crops and grass waterways that help retain and more slowly release water. And the new computer systems can identify the best places for all of these approaches to be used.

One of the main reasons guys dislike using condoms? decreased pleasure?could be solved thanks to (get ready for this) Bill Gates.

That?s right, the tech guru and philanthropist is challenging someone to come up with a rubber that still protects against STIs yet maintains or even increases pleasure. The Bill and Melinda Gates Foundation is offering a $100,000 grant, with the possibility of $1 million, to anyone who can successfully tackle the challenge.

While it would be sweet to think that Gates was most concerned with enhancing our between-the-sheets sessions, there is a larger goal here: to diminish the prevalence of HIV. The foundation has found that the main deterrent to wrapping it up is not a lack of resources but rather a lack of incentive.

Given that the little rubbers have the power to prevent STIs, HIV, and pregnancy and have no associated adverse events (which is more than any other form of BC can boast), what's not to love?

Cultural stigma and decreased pleasure and intimacy are the main reasons people forgo love gloves, the foundation says. "The primary drawback from the male perspective is that condoms decrease pleasure as compared to no condom, creating a trade-off that many men find unacceptable, particularly given that the decisions about use must be made just prior to intercourse," reads a post on the foundation's blog "Inpatient Optimists."

But ladies, don't point the finger at men: Women are also loose with their condom use, as reported in a study from Stanford Medical Center last year that found that women have a tendency to stop condom use once they start hormonal contraceptives.

Aside from the related worldwide health risks, the condom is also long overdue for an upgrade. In the past 50 years, we've seen multitudes of technological advancements, but besides implementing latex and allowing for individual product testing, condoms have hardly changed, the foundation points out.

We'd say it's time to revamp the rubber. And stat.

Prebiotics: Do supplements in baby formula help prevent allergies?

Mar. 25, 2013 ? Prebiotic supplements in infant formula may help to prevent eczema, according to a systematic review published in The Cochrane Library. However, the review highlights a lack of high quality evidence for the effects of prebiotics in preventing allergies.

It is thought that bacteria lining the gut may play an important role in a child developing sensitivities to certain foods and allergens, regulating immune responses and determining how they will react to the same substances in later life. Prebiotics are indigestible components of breast milk, fruit and vegetables that stimulate the growth and activity of healthy bacteria in the gut. They are distinct from probiotics, which are cultures of live bacteria such as those added to yoghurts and infant formula. Prebiotics can also be added to infant formula. However, it is unclear exactly what effect these supplements have on the development of allergies.

The researchers drew together data from four studies involving a total of 1,428 children. Children were given formula containing prebiotic supplements or, as a control, standard formula. Studies followed children to between four months and two years of age and reported the number who developed allergies. Eczema was significantly reduced in children who were fed formula containing prebiotics. Only two studies investigated asthma. The number of children who developed asthma was similar whether they were given formula with added prebiotics or without. In one study looking at urticaria (hives), giving children formula containing prebiotics did not prevent any cases of the allergy.

Only one study assessed the effect of giving formula containing prebiotics to high-risk children, who had close family members with allergies. In this study, prebiotics reduced both eczema and asthma, but there were no significant reductions in allergies overall in high-risk children. "Given these findings, it remains unclear whether the use of prebiotics should be restricted to infants at high risk of allergy or may have an effect in low risk populations," said lead researcher, John Sinn of the University of Sydney in Sydney, Australia.

"Overall, we found some evidence that infant formula containing prebiotic supplements can help prevent eczema in children up to two years of age," said Sinn. "However, the quality of existing evidence is generally low or very low. More high quality research is needed before we can recommend routine use of prebiotics for prevention of allergy."

How diabetes drug delays aging in worms

Mar. 28, 2013 ? A widely prescribed type 2 diabetes drug slows down the aging process by mimicking the effects of dieting, according to a study published today using worms to investigate how the drug works.

Following a calorie-restricted diet has been shown to improve health in later life and extend lifespan in a number of animals, ranging from the simple worm to rhesus monkeys. The type 2 diabetes drug metformin has been found to have similar effects in animals but until now it was not clear exactly how the drug delays the aging process.

Researchers supported by the Wellcome Trust and Medical Research Council looked at the effects of metformin on C. elegans worms that were grown in the presence of E. coli bacteria, a relationship similar to that which humans have with the 'healthy' bacteria in our gut. They found that the worms treated with metformin lived longer only when the E. coli strain they were cultured with was sensitive to the drug.

Dr Filipe Cabreiro from the Institute of Healthy aging at UCL, who led the research, explains: "Overall, treatment with metformin adds up to 6 days of life for the worm which is equivalent to around a third of its normal lifespan. It seems to work by altering metabolism in the bacteria that live in the worm, which in turn limits the nutrients that are available to the worm host and has a similar effect to restricting the diet."

Bacteria living in the gut have an important role in helping the host organism to digest and extract nutrition from food. Defects in gut bacteria have been linked to metabolic diseases such as obesity, diabetes, inflammatory bowel disease and cancer. It has also been suggested that gut bacteria may have an impact on the aging process, but this is the first study to suggest a mechanism for how this works.

The team used strains of E. coli with defects in genes that are linked to metabolism and tweaked the levels of nutrients available to tease out which metabolic pathways might be affected by the drug. They found that treatment with metformin disrupted the bacteria's ability to metabolise folate, a type of B-vitamin, and methionine, one of the building blocks of proteins. This limits the nutrients that are available to the worm and mimics the effects of dietary restriction to enable the worms to live longer.

However, when they added an excess of sugar to the diet, the team found that the life-extending effects of metformin were cancelled out. As the drug is used as a treatment for diabetes caused by elevated glucose levels in the blood, this finding is particular relevant for understanding how the drug works in people.

Professor David Gems, who directed the study, said: "We don't know from this study whether metformin has any effect on human aging. The more interesting finding is the suggestion that drugs that alter bacteria in the gut could give us a new way of treating or preventing metabolic diseases like obesity and diabetes."

Metformin is currently one of the most widely prescribed drugs and the findings should help to inform how it is used in patients.

Each post, which will run on Thursdays over the course of five weeks, will explore solutions to help businesses overcome barriers to better integrate environmental sustainability into their operations.]

David Roberts at the online news organization Grist commented last week on Twitter that "people talk about 'externalities' like they are just bad vibes or something. But that money is real money. Those costs are real costs."

How real is that money? Pavan Sukhdev, author of "The Economics of Ecosystems and Biodiversity" and "Corporation 2020," claims that these "externalities" -- or costs to society from carbon emissions, water use, pollutants and other byproducts of business activities -- are more than $2 trillion.

Putting a financial value on these environmental costs can help businesses make better-informed decisions about how they manage their environmental risk. Not all companies recognize this -- and even fewer actually know how to value these externalities correctly. But a few corporations are starting to show us the way.

Learning from Puma's environmental profit and loss statement

Puma is one company that thinks this is an important issue. While all companies have to develop profit and loss statements, Puma is the first to develop an environmental profit and loss statement. The company valued the environmental impact of its operations and supply chain in 2010 at about $190 million, factoring in impacts like water use, greenhouse gas emissions, land use conversion, air pollution and waste.

The company is now using this statement as a way to drive environmental initiatives, which it views as key to its long-term commercial survival. Puma's environmental profit and loss statement?is helping employees, shareholders and suppliers understand the magnitude of the company's environmental impacts, prioritize which ones to tackle first and incorporate this information into decision-making.

Customer Complains About Lululemon Sheer Pants - Business Insider

A disgruntled customer says that Lululemon employees made her bend over to prove her pants were see-through.?

The yoga retailer announced it was recalling 17 percent of its pants last week because many were too sheer.?

The Consumerist first reported about the woman's complaint, made on the Lululemon Facebook page.?

"I went into my local store to return my Astro pants and Invert crops, both purchased this month. I was asked to BEND OVER in order to determine sheerness. The sales associate then perused my butt in the dim lighting of the change room and deemed them ?not sheer?. I felt degraded that this is how the recall is being handled. I called the GEC to confirm this is their protocol, and they verified that yes, the ?educators? will verify sheerness by asking the customer to bend over.

Please explain as to how this is gratifying customer service? If I think my black Luon pants are sheer and there is a mass recall happening, am I not entitled to go in without having to BEND OVER and obtain a refund?"


But Lululemon's Facebook administrator quickly worked to address the woman's complaint, offering to contact her local store.

"?We don?t need to see our guests in the garments to deem them sheer. We want our guests to be comfortable in their products and will make it right for them if they feel their black bottoms are sheer."?

Carolyn?Beauchesne, author of?the blog Lululemon Addict,?also reported about women who said they had to bend over in stores to prove sheerness.?

"Lululemon has been pretty?tone-deaf in handling quality issues before?but this really takes the cake," Beauchesne wrote.?

Beauchesne also suggested a solution for the controversy.?

"Publishing a list of items that have been recalled would help clear up a lot of confusion," she wrote. "No list has been released?as of yet."

NEW YORK (TheWrap.com) - Candice Bergen will play Robin Williams' wife in "A Friggin Christmas Miracle," an upcoming comedy about a dysfunctional family during Christmas time, Tom Rice of Sycamore Pictures, which is financing and producing the film, told TheWrap.

Bergen's character Donna Mitchler is the Wisconsin matriarch of said family.

Phil Johnston's script follows Boyd (Joel McHale), Donna's son, who forgets his son's presents at home. To save Christmas, he ventures out on the road with his father Mitch (Williams) and brother Nelson (Clark Duke).

Duke just joined the cast this week, and his character speaks fluent Farsi despite having suffered brain damage after falling off a truck in basic training.

Wendi McLendon-Covey plays Boyd and Nelson's sister Shauna while Tim Heidecker will play her trucker husband.

Tristram Shapeero is directing and the Russo Brothers, who are about to direct the "Captain America" sequel, are producing with Rice.

Bergen, a five-time Emmy winner and recipient of two Golden Globes, last appeared on the big screen in Galt Niederhoffer's 2010 "The Romantics" and 2009 romantic comedy "Bride Wars."

Best known as the lead in hit TV series "Murphy Brown," her most famous film performances came in "Gandhi," "The Wind and the Lion" and "Starting Over," for which she earned an Oscar nomination.

Production of "A Friggin' Christmas Miracle" is just getting under way in Atlanta.

Gameloft bringing Iron Man 3 to Android on April 25

We saw the teasers yesterday, and today Gameloft has announced that Iron Man 3 is coming to Android. It's set to launch on April 25, and it looks like a new breed of endless runner. 

Before you complain about yet another endless running game, be sure to check the trailer above. Flying above city streets, firing a lazer at obstacles and enemies is a far cry from Temple Run. This looks like a ton of fun, and even if you're not a fan of Iron Man, who doesn't love to blow the bad guys out of the sky?

No news on what this one's going to cost, all Gameloft is telling us is the date and where to see the trailer. When it comes, we'll have a good look at it.

(AP) ? A new study finds that insurance companies will have to pay out an average of 32 percent more for medical claims on individual health policies under President Barack Obama's health care overhaul.

What does that mean for you?

It could increase premiums for at least some Americans.

If you are uninsured, or you buy your policy directly from an insurance company, you should pay attention.

But if you have an employer plan, like most workers and their families, odds are you don't have much to worry about.

The estimates from the Society of Actuaries could turn into a political headache for the Obama administration at a time when much of the country remains skeptical of the Affordable Care Act.

The administration is questioning the study, saying it doesn't give a full picture ? and costs will go down.

Actuaries are financial risk professionals who conduct long-range cost estimates for pension plans, insurance companies and government programs.

The study says claims costs will go up largely because sicker people will join the insurance pool. That's because the law forbids insurers from turning down those with pre-existing medical problems, effective Jan. 1. Everyone gets sick sooner or later, but sicker people also use more health care services.

"Claims cost is the most important driver of health care premiums," said Kristi Bohn, an actuary who worked on the study. Spending on sicker people and other high-cost groups will overwhelm an influx of younger, healthier people into the program, said the report.

The Obama administration challenged the design of the study, saying it focused only on one piece of the puzzle and ignored cost relief strategies in the law, such as tax credits to help people afford premiums and special payments to insurers who attract an outsize share of the sick.

The study also doesn't take into account the potential price-cutting effect of competition in new state insurance markets that will go live Oct. 1, administration officials said.

At a White House briefing Tuesday, Health and Human Services Secretary Kathleen Sebelius said some of what passes for health insurance today is so skimpy it can't be compared to the comprehensive coverage available under the law. "Some of these folks have very high catastrophic plans that don't pay for anything unless you get hit by a bus," she said. "They're really mortgage protection, not health insurance."

Sebelius said the picture on premiums won't start coming into focus until insurers submit their bids. Those results may not be publicly known until late summer.

Another striking finding of the report was a wide disparity in cost impact among the states.

While some states will see medical claims costs per person decline, the report concluded that the overwhelming majority will see double-digit increases in their individual health insurance markets, where people purchase coverage directly from insurers.

The differences are big. By 2017, the estimated increase would be 62 percent for California, about 80 percent for Ohio, more than 20 percent for Florida and 67 percent for Maryland. Much of the reason for the higher claims costs is that sicker people are expected to join the pool, the report said.

Part of the reason for the wide disparities is that states have different populations and insurance rules. In the relatively small number of states where insurers were already restricted from charging higher rates to older, sicker people, the cost impact is less.

The report did not make similar estimates for employer plans that most workers and families rely on. That's because the primary impact of Obama's law is on people who don't have coverage through their jobs.

A prominent national expert, recently retired Medicare chief actuary Rick Foster, said the report does "a credible job" of estimating potential enrollment and costs under the law, "without trying to tilt the answers in any particular direction."

"Having said that," Foster added, "actuaries tend to be financially conservative, so the various assumptions might be more inclined to consider what might go wrong than to anticipate that everything will work beautifully." Actuaries use statistics and economic theory to make long-range cost projections for insurance and pension programs sponsored by businesses and government. The society is headquartered near Chicago.

Bohn, the actuary who worked on the study, acknowledged it did not attempt to estimate the effect of subsidies, insurer competition and other factors that could offset cost increases. She said the goal was to look at the underlying cost of medical care.

"We don't see ourselves as a political organization," Bohn added. "We are trying to figure out what the situation at hand is."

On the plus side, the report found the law will cover more than 32 million currently uninsured Americans when fully phased in. And some states ? including New York and Massachusetts ? will see double-digit declines in costs for claims in the individual market.

Uncertainty over costs has been a major issue since the law passed three years ago, and remains so just months before a big push to cover the uninsured gets rolling Oct. 1. Middle-class households will be able to purchase subsidized private insurance in new marketplaces, while low-income people will be steered to Medicaid and other safety net programs. States are free to accept or reject a Medicaid expansion also offered under the law.
